General information
These Terms govern access to and use of the Marco Marchioni Photo website, available at marcomarchioni.photo, and regulate, where active, requests or purchases of Fine Art prints, photographic products, image-use licences, collaborations, editorial content and related services.

Fine Art prints and photographic products are not ready-made stock items: they are produced after purchase, based on the photograph selected by the customer and the available or agreed options. Production and shipping may also be handled through on-demand print partners, including Creative Hub.
Before completing an order, the customer is invited to carefully read these Terms, the Privacy Policy and the Cookie Policy. Placing an order implies acceptance of the conditions applicable to the sale.
Purpose of the website and services
The website presents photographs, portfolios, galleries, projects, editorial content and information about the services offered by Marco Marchioni Photo.
Depending on the active configuration, the website may provide:
- the sale of Fine Art photographic prints or photographic products;
- requests for quotes for prints, sizes, supports, frames or shipping;
- requests for image-use licences for editorial, commercial, institutional or creative purposes;
- requests for photographic collaborations, content production or special projects;
- information or requests relating to photographic trips, nature activities or initiatives connected to Next Stop Earth, where present.
Any services that cannot be purchased directly through the online checkout may be governed by quotes, written agreements, confirmation emails or specific conditions communicated to the customer.
Fine Art prints, products and licences
The photographs by Marco Marchioni that can be purchased as Fine Art prints or photographic products are printed only after the order has been confirmed. They are not prints already available in stock or ready for immediate resale: each order starts a specific production process through a POD / print-on-demand workflow, including through Creative Hub or other technical printing and shipping partners.
The customer chooses the photograph and, where available, the size, support, finish, quantity, any frame, shipping destination or other specifications shown in the product page or agreed by email. The print is then produced specifically for that order.
For this reason, the Fine Art prints and photographic products sold through Marco Marchioni Photo are non-prefabricated goods, produced after purchase on the basis of the customer’s individual choice. They are not standard products already ready before the order.
The images shown on the website are for illustrative purposes. Colours, brightness, contrast and visual rendering may vary depending on the device used by the user, screen calibration, the selected support and the printing process.
Exclusion of the withdrawal right for prints: since all prints and photographic products are produced only after purchase through an on-demand / POD process, the customer cannot exercise the right of withdrawal for a simple change of mind, change of preference, incorrect choice of size or subjective preference after order confirmation. The customer’s rights remain fully protected in the event of a damaged, defective, incorrect or non-conforming product.
Image-use licences do not transfer ownership of the photographs. Any licences are granted only within the limits set out in the quote, contract, confirmation email or specific applicable conditions.
Orders and contract conclusion
An order may be placed through the online checkout, where available, or through a direct request via the contact form or email.

Marco Marchioni Photo may refuse, cancel or suspend orders in the event of incomplete or inaccurate data, failed payment, product unavailability, an obvious pricing error or suspected improper use of the website.
Prices and payments
Prices are shown in the currency displayed on the website or in the quote. Unless otherwise stated, any taxes, shipping costs, packaging costs, duties, customs charges or additional costs are shown before order confirmation or communicated in the quote.
Payment may be made through the methods available on the website, such as payment card, Stripe or other gateways, bank transfer or other agreed methods. Full card details are not stored directly by Marco Marchioni Photo.
If payment is not authorised, not completed or revoked, the order cannot be processed or may be suspended until the issue is resolved.
Production, shipping and delivery
After order confirmation, the print is sent into production through the technical workflow provided for the selected product. Production may be managed directly or through on-demand print partners, including Creative Hub, which may handle printing, packaging and/or shipping.
Prints and physical products are shipped to the address provided by the customer at the time of the order or agreed by email. The customer is responsible for the accuracy of the shipping details provided.
Production, preparation and delivery times are indicative and may vary depending on availability, size, support, print lab, POD partner, destination, courier and time of year.
Upon delivery, the customer is invited to check the integrity of the packaging. If the package is damaged, tampered with or visibly compromised, it is advisable to accept it with reservation, document the damage with photographs and promptly contact Marco Marchioni Photo.
Right of withdrawal
For distance contracts concluded with consumers, the law may generally provide a 14-day right of withdrawal. However, this right does not apply when the purchased good falls within the exceptions provided by law, including the supply of goods made to the consumer’s specifications or clearly personalised.
In the case of Marco Marchioni Photo, Fine Art prints and photographic products are produced only after purchase through a print-on-demand / POD workflow, based on the photograph selected by the customer and the chosen or available options. For this reason, these products are not sold as ready-made stock items and do not give the customer a withdrawal right for a simple change of mind after order confirmation and the start of production.
Important: the exclusion of the withdrawal right applies to prints and photographic products produced on demand after purchase. It does not limit the customer’s rights in the event of a damaged, defective, incorrect or non-conforming product.
On-demand prints and no withdrawal right
All photographic prints sold through Marco Marchioni Photo are produced at the time of purchase. Even when the photograph is already present in the catalogue or gallery, the physical print is not ready before the order: it is produced afterwards through a POD / print-on-demand process, including through Creative Hub.

The customer must carefully check the order before confirmation, including the selected photograph, size, support, quantity, shipping address and billing details. Once the order has been confirmed and production has started, it is not guaranteed that it can be changed or cancelled.
Returns, refunds and order support
Returns are not accepted for a change of mind, change of preference, incorrect choice of photograph, size, support or quantity, change in personal taste or subjective assessments made after order confirmation, when the product is a Fine Art print or photographic product produced on demand after purchase.
The customer may instead request assistance if the product received is damaged, defective, incorrect or non-conforming with respect to the confirmed order. In these cases, the customer must write to info@marcomarchioni.photo, indicating the order number, a description of the problem and attaching photographs of the product and packaging.
When the non-conformity is verified, Marco Marchioni Photo may propose, depending on the specific case, a reprint, replacement, repair, full or partial refund, or another solution agreed with the customer. When production or shipping is handled by Creative Hub or another POD partner, the verification may require technical checks with the partner involved.
Any authorised returns must be made according to the instructions received. The product must be properly packaged and protected during transport.
Damaged or non-conforming products
If the product arrives damaged, defective or non-conforming with the order, the customer must contact Marco Marchioni Photo as soon as possible at info@marcomarchioni.photo, attaching a description of the problem, the order number and clear photographs of the product, the damaged or non-conforming detail and the external/internal packaging.
It is important to keep the product, packaging and shipping documentation until the verification is completed, as they may be needed for checks with the print lab, courier or insurance provider.
In the event of an ascertained defect, error or non-conformity, Marco Marchioni Photo may propose, depending on the case, a replacement, reprint, repair, full or partial refund, or another solution agreed with the customer.
The rights granted to consumers by the applicable legal guarantee of conformity remain unaffected.
Copyright and intellectual property
All photographs, images, texts, graphics, logos, editorial content and materials on the website are protected by copyright and intellectual property laws.
It is forbidden to copy, download, reproduce, modify, distribute, publish, commercially use or exploit in any way the images and content of the website without the written authorisation of Marco Marchioni or the legitimate rights holder.
The purchase of a print allows ownership of the physical item purchased, but does not grant any right to reproduce, publish, distribute or commercially use the image.
Image-use licences must be agreed in writing and, depending on the case, specify purpose, duration, territory, media, limits, exclusivity or non-exclusivity and fee.
Liability and use of the website
Marco Marchioni Photo undertakes to keep information accurate and up to date, but does not guarantee that the website will always be free from errors, interruptions, technical inaccuracies or temporary access problems.
The website may contain links to third-party services or websites. Marco Marchioni Photo is not responsible for content, policies, services or data processing carried out by independent third parties.
The user undertakes to use the website lawfully, correctly and in accordance with these Terms, avoiding any improper, fraudulent, harmful or unlawful use.
Privacy and cookies
Personal data is processed as described in the Privacy Policy. The use of cookies and similar technologies is governed by the Cookie Policy and by the consent banner available on the website.

Applicable law, changes and contacts
These Terms are governed by Italian law, without prejudice to any mandatory rules applicable to the consumer in their country of residence.
For consumers, the jurisdiction provided by the applicable consumer protection legislation remains unaffected. For professional or business customers, any disputes will be handled as agreed between the parties or according to the applicable law.
Marco Marchioni Photo may update these Terms at any time. Changes apply from the date of publication on the website and do not affect orders already confirmed, unless otherwise required by law.
